2. Intellectual and industrial property

The Portal, including its source code, design, the Company's services, digital content, images, videos, and distinctive marks, along with any other content eligible for protection, are comprehensively safeguarded by intellectual and industrial property rights owned by the Company or third parties. This means that it is strictly forbidden to engage in actions such as sharing, copying, reproducing, communicating, disseminating, distributing, commercializing, or utilizing for promotional purposes, whether in whole or in part, any of the Portal's content. This prohibition applies, for instance, but is not limited to, unless you possess the explicit authorization from the Company.

3. Access to the service

• The Company offers a service of providing digital entertainment content for users of compatible devices under a subscription and payment model by charging the mobile bill.
• The Platform: Offers the best contents of Entertainment and Sports - Live streams and VOD replays.
• Once subscribed, the user will be able to access unlimited digital content offered by the Company through the Portal, which may be updated periodically at the Company's discretion.
• The subscription amount will be reflected in the invoice of the mobile operator with which the subscriber maintains the corresponding contract, whether postpaid or prepaid.
• To access the Service you require an Internet connection, which may involve an additional cost depending on the rate you have contracted with your mobile operator. Additionally, you must have a compatible device and updated software to connect to the Service. You can check the compatibility in point 6.
• The conditions are public and accessible on the Portal permanently.
• Our Platform is intended for individuals who are at least 18 years old or the legal age of majority in their jurisdiction. If you are under the age of 18 or the legal age of majority, you may only access or use the Platform with the consent and supervision of a parent or legal guardian. By accessing or using the Platform, you represent and warrant that you have obtained such consent.

4. User and subscriber condition

User is the person who accesses, browses or uses the Portal or accesses the Service with the consent of the subscriber. The user may or may not coincide with the subscriber.
Service Subscriber is the owner of the line and telephone number with a current postpaid or prepaid contract with a mobile operator. The subscriber may or may not coincide with the user.

5. Rates

Different rates apply depending on your coountry and sometimes depending on your mobile phone operator.

6. Compatibility of services

Platform is accessible and compatible with all the modern devices and browsers- smartphones, tablets and computers. Displaying of some features might differ from one device to other.
Compatible with Mac, PC, Tablets and Smartphones that use any of the following browsers: IE10, IE11, Firefox, Safari, Opera, Chrome. Important: Some digital content on this service is not compatible with Windows Phone, Internet Explorer, iPhone versions before iPhone 5, and Android versions before 4.4.

7. Notifications

User might receive SMS messages upon subscribing, unsubscribing and being charged for the service.

8. Right of withdrawal and refund policy

The Subscriber is expressly informed that they have a right to cancel their subscription.
To unsubscribe, user can follow the instructions in the welcome SMS received from the service. User can also contact us at contact@fighterlive.com. User can also contact their carrier and ask for being unsubscribed from the service.
In the majority of cases the paid amount for service is not reimboursed, as the subscription process implies full user agreement. User may be reimboursed in specific situations. Particular cases are being reviewed directly with the service and the operator.
In the event that the user requests reimbursement of amounts accrued and/or received by MOBIBASE and/or the mobile operator, each specific case will be studied taking into account the circumstances that occurred and the refund policy agreed with the mobile operator in every moment.

9. Responsibility of the User and/or the Subscriber

The User and/or the Subscriber may not use the Service for commercial purposes or any other use other than those defined in this contract. In the same way, the User/Subscriber must respect and observe the applicable legislation, particularly that relating to the protection of rights owned by third parties, including, but not limited to, intellectual and industrial property rights and especially the trademarks and other distinctive signs.
The User and/or the Subscriber assumes under their exclusive responsibility the consequences that may arise from illegal, illegitimate and not permitted access or use of the digital content offered. The user may not reproduce, alter or disseminate the digital content offered without the prior written consent of the Company.
The Subscriber must be of legal age to contract the Services. The owner of the telephone line through which the subscription has been made will always be responsible for paying for the corresponding service.
The videos and pictures available on our Platform are protected by copyright laws and other intellectual property rights. You may access and view the content solely for personal, non-commercial purposes.
User/Subscriber agrees not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Platform's videos or pictures without obtaining explicit permission from the respective copyright owner.
User/Subscriber is solely responsible for the use of the Platform's video content. Any unauthorized use of the content may violate copyright laws, and you may be liable for any resulting infringement or damages.

10. Company Liability

The Company is responsible for the provision of the Services in the terms set forth above. Liabilities arising from force majeure are excluded.
The Company will not be responsible for any losses or damages suffered by the User and/or the Subscriber that result, directly or indirectly, attributable to the failure by the User to comply with the obligations derived from this contract.
In accordance with the provisions of our legal system, the company's liability for damages will have an economic limit equivalent to the amoun paid by the Subscriber for the contracted Services.

12. Jurisdiction and applicable legislation

These T&C are governed by French Law. The Company, with address at 1300 Route des Crêtes, Wtc Bâtiment L, 06560 Sophia Antipolis, France, is subject to the Nice Commercial Court. Any dispute resulting from the application of this Terms and Conditions and which cannot be concluded by friendly settlement shall be brought before the competent court or jurisdiction of Nice Commercial Court.
